Furthermore, the civil-law notary Mariusz Bańkowski, as a translator of English for many years, fluent in the English language, allows giving legal advices associated with the notarial act in the English language, but a notarial act itself requires the presence of a certified translator. THE SCOPE OF ACTIVITIES
The Civil-Law Notary Office Mariusz Bańkowski provides the following notarial services:
1) drawing up notarial deeds;
2) drawing up notarial certifications of succession;
3) taking activities on European certificates of succession;
4) taking activities associated with a succession management of an enterprise of a natural person and an interim representative in the scope of participation of a spouse of an entrepreneur in the enterprise, on the basis of rules stipulated in the Act on a Succession Management of an Enterprise of a Natural Person and on Other Facilities Connected with Succession of Enterprises (Journal of Laws item 1629 and of 2019, item 1495);
5) drawing up certificates;
6) taking minutes;
7) drawing up protests of bills of exchange and cheques;
8) accepting for safekeeping money, securities, documents, data on an IT data storage media, which is stipulated in provisions on IT implementation of the activity of entities performing public administration tasks;
9) maintaining the registers of shareholders of simple joint-stock companies and taking activities associated with these registers;
10) drawing up certified copies, official copies and certified extracts of documents;
11) on the request of parties drawing up drafts of notarial deeds, statements and other documents;
12) submitting applications to make an entry in the land and mortgage register together with documents, which constitute the basis to an entry in the land and mortgage register;
13) taking other activities, which are stipulated in separate regulations.
DOCUMENTS
The scope of documents required for a legal act depends on several factors, that is to say the type and content of the provided notarial act, state of affairs and legal situation of the given case. What is more, the scope of documents is determined individually in every case by the civil-law notary or employees of the civil-law notary office. During every notarial act the valid identity document, that is to say identity card, passport or residence card (in case of foreigners) is required. If the subject of the notarial act is to be:
- immovable,
- perpetual usufruct,
- cooperative ownership right to premises
before contacting with the Civil-Law Notary Office Mariusz Bańkowski please prepare the number of the land and mortgage register maintained for the immovable or the right to premises or submit the legal title (e.g. certified copy of a notarial deed, official copy of the land and mortgage register, final and non-appealable court judgement). Verification of content of the land and mortgage register will allow to specify the list of required documents. The specified earlier documents should be submitted to the civil-law notary office in advance so that a draft of notarial deed can be drawn up. At the preliminary stage, it is sufficient to submit copies of documents in a manner convenient for You: electronically, personally, by post or by messenger service. On the day of a notarial act all required documents have to be presented in originals. You may receive all information concerning required documents to a notarial act in the secretary’s office, by phone or by e-mail.
FEES
For notarial acts the Civil-Law Notary Office Mariusz Bańkowski is entitled to remuneration in accordance with content of the Regulation of Minister of Justice on the maximum notarial fee rates of 28 June 2004 plus applicable VAT tax rate. In order to determine notarial costs, please contact personally or by phone with the civil-law notary office. Civil-Law notary as a taxpayer is obliged to collect during notarial acts: transfer tax, inheritance and gift tax and court fees. Giving legal advices associated with the notarial acts, also in the English language, is free of charge.
